Upcoming Commission Activity

  • CPSC Agenda and Priorities for Fiscal Years 2023 and 2024 (Public Hearing via Webinar on April 27, 2022)

On April 27, 2022, beginning at 10 a.m. EDT, CPSC will conduct a public hearing to receive views from all interested parties about the Commission’s agenda and priorities for fiscal year 2023, which begins on October 1, 2022, and for fiscal year 2024, which begins on October 1, 2023. For additional information, please see the Public Calendar notice.

Highlights of Recent Commission Activity

  • Proposed Rule: Safety Standard for Clothing Storage Units (comment period closes April 19, 2022) FINAL DAY TO COMMENT

To address the risk associated with CSU tip overs, the Commission proposes a rule, under the CPSA, to require CSUs to be tested for stability, exceed minimum stability requirements, be marked and labeled with safety information, and bear a hang tag providing performance and technical data about the stability of the CSU. For additional information, or to submit a comment, please see the Federal Register notice.

  • Prohibition of Children’s Toys and Child Care Containing Specific Phthalates (comment period closes May 9, 2022)

In March 2021, the U.S. Court of Appeals for the Fifth Circuit remanded without vacating the phthalates final rule to the CPSC to address two procedural deficiencies. The court held that the final rule had failed to: (1) Provide adequate notice and comment regarding a change in the primary justification from the proposed rule to the final rule; and (2) consider the cost and benefits of continuing the interim prohibition on DINP.  These were addressed in a  Federal Register notice, which includes a request for comments.

  • Commission Public Meetings and Briefings in March and early April 2022: The Commission held several public meetings in March and early April on various topics under CPSC’s jurisdiction. The recordings are available on the CPSC YouTube Channel:

  • Reckitt Recalls More than Three Million Bottles of Airborne Gummies Due to Injury Hazard

On March 16, 2022, in cooperation with CPSC, Reckitt announced a recall of more than three million 63 and 75 count bottles of Airborne Gummies. When opened for the first time, pressure build up in the bottle can cause the cap and underlying seal to pop off with force, posing an injury hazard. Reckitt has received 70 reports of the cap or seal popping off the bottles, including 18 reports of minor injuries and one report of an eye injury requiring medical attention. Consumers with an unopened bottle(s) should not attempt to open the product and should contact Reckitt to return the unopened bottle(s) to receive a full refund. A postage-paid label will be provided. Bottles that have already been opened are not subject to this recall, as they would have released any pressure build up and do not present an injury hazard. • Older Americans Are More Likely to Suffer Fatalities from Falls and Fire; CPSC Report Highlights Hidden Hazards Around the Home

Americans over age 65 comprise 71% of consumer-product related deaths annually, despite making up only 16% of the population. According to the CPSC staff report, nearly three million older adults visit the emergency room each year for product-related injuries. Consumer products are also associated with about 3,800 reports of older adult deaths each year. Falls are by far the most common product-related cause of injuries and deaths to older Americans. Other top hazards include fires, drowning, transportation under CPSC jurisdiction, such as off-highway vehicles, bicycles, and e-scooters, CO poisoning, and bed rail entrapment. Older adults and their caregivers can work to prevent these tragic injuries and deaths by following safety steps, such as: installing handrails on both sides of any stairs in your home, keeping stairs well-lit and free of clutter, and installing smoke alarms on every level of the home outside sleeping areas and inside each bedroom, and installing carbon monoxide alarms on each floor.
